 Breaking News! Final Rule for Hours of Service -  This final rule is effective January 19, 2009. It essentialy upholds the the December 17, 2007 interim rule of the 11 and 14 hour rules and the the 34 hour restart. Federal Motor Carriers news release can be read HERE.

Commercial Vehicle or not?

1. GVWR/GCWR or actual physical weight of 10,001lbs or more
2. Designed to transport more than 8 passengers including
the driver for compensation;
3. Is designed or used to transport more than 15 passengers
including the driver and is not used to transport passengers
for compensation; or
4. Is used to transport Hazmat

Read CFR 390.5

The 4 ways to accumulate a 10 hour rest period (paraphrased
from 395.1(g))

1) 10 consecutive unbroken hours 'Off Duty' 
2) 10 consecutive unbroken hours in the 'Sleeper Berth'
3) A combination totaling 10 hours 'Off Duty' and
'Sleeper' if it is consecutive and unbroken.
4)  An equivalent period of 10 hours that has one rest period
of at least 8 hours in the 'Sleeper Berth' and a separate period
of at least 2 hours but less than ten hours in the
'Sleeper Berth' or 'Off Duty', or any combination.

NOTE: Any time less than 8hrs in the sleeper will count against you!
That includes 'Sleeper Berth and 'Off Duty'.

Scroll down 395.1(g) to where it reads:
"
(g)(1)(ii)(A) The term "equivalent of at least 10 consecutive
hours off duty" means a period of
..."
Read carefully!
Suggestion: When you come on duty, count out 14 hours from
the time you start and mark it on your log - Thats when you'll
need to stop. Plan your trip accordingly!

IFTA Fuel tax, IRP and UCR

You are an IFTA qualified motor vehicle if you:

Have two axles and a registered gross vehicle weight more than 26,000lbs

Have three or more axles regardless of weight
Is used in combination when the weight of the combination excees 26,000lbs

In general, not less than 2/32" on the back, and
4/32" on the front axle

General CVSA requirments
Below is an excerpt from the latest CVSA OOS criteria. Keep in mind there are more types of brakes and chamber sizes. The examples of brake sizes listed below are for clamp type air brakes of standard and long stroke brakes.
If your brakes are right at these adjustment limits, no violaton.You are declared "Out of Service" by North American Standards if you have 20% or more brakes out of adjustment.
For example, a standard tractor/trailer 5 axle truck has 10 brakes, 2 brakes out of adjustment meets the 20% critera.

Standards can always change on a moments notice
, so its always best to get yourself a copy of the OOS criteria.

Type 16 / 1 3/4" / LS = 2"
Type 20 / 1 3/4" / LS = 2"
      Type 24 / 1 3/4" / LS = 2 1/2"

Weight laws, and USDOT regulations.

USDOT numbers must be on your truck! ICC/MC numbers are not
mandatory anymore. Truck must be marked on both sides on a sharply contrasting back ground.
